This Privacy Notice explains how we collect and use your personal data, it describes the categories of personal data we process and for what purposes. We are committed to collecting and using such data responsibly and in accordance with the requirements of the General Data Protection Regulation (GDPR).

We respect individuals’ rights to privacy and to the protection of personal information.  “Personal Information” means information about a living individual who can be identified from that information (either by itself or when it is combined with other information).

How we gather and use personal information

We need to obtain information about you so that we can provide the financial advice you require. This information is normally collected at the start of and as necessary throughout the duration of your relationship with us directly in a face to face meeting. It may also be obtained by telephone, post, email or other means.

We will limit the collection and processing of information to only what is necessary to achieve one or more legitimate purposes as identified in this notice.

We may also obtain information from other organisations such as investment, pension, insurance and mortgage providers, where you have provided authority for them to share information relating to your existing plans or from your professional advisers, where you have provided authority for them to share information.

We hold such information as Data Controllers in accordance with the requirements of the Isle of Man Data Protection Act 2018 and the EU General Data Protection Regulation, together referred to as the ‘Regulations’. We use this information to analyse your current and future financial needs so we can ensure any subsequent advice takes due account of, and is suitable to, your circumstances. We will not share your information with any other party except as indicated in this Privacy Notice or where required to do so by any statutory, governmental or regulatory body for legitimate purposes or law enforcement agencies.

What information do we collect about you?

We collect information about you when you engage us for financial planning or other services. This information will relate to your personal and financial circumstances. It may also include special categories of personal data such as data about your health and medical conditions, if this is necessary for the provision of our services.

Information relating to usage of our website is collected using cookies. These are text files placed on your computer to collect standard internet log information and visitor behaviour information.

Where is your personal information kept?

Your information is held securely in various formats at our offices at Prospect Hill and electronically both at our offices and on servers located on the Isle of Man and within the EU.

We take great care in protecting personal information from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

 Why do we need to collect and use your personal data?

The primary legal basis we intend to use for the processing of your data is for the performance of, or entry into, our contract with you. The information we collect about you is essential for us to be able to carry out the services you require from us effectively. Without collecting your personal data we would also be unable to fulfil our legal and regulatory obligations.

We may also process data where we have a legitimate interest in doing so as a financial services provider (and where our legitimate interests are not overridden by your (or the relevant individual’s) own interests or fundamental rights or freedoms).

How will we use the information about you?

We collect information about you in order to provide you with the services for which you engage us.

Information about connected individuals

We may need to gather personal information about your close family members and dependents to provide our service to you effectively. In such cases it will be your responsibility to ensure you have the consent of the people concerned to pass their information on to us. We can provide a copy of this Privacy Notice to them on request or, where appropriate, ask you to pass the privacy information to them.

Who might we share your information with?

We will not share your information for marketing purposes with other companies without your consent.

To deliver our services to you effectively we may need to share your personal information with third parties such as those that we engage for accountancy or legal services as well as product and platform providers, which we use to arrange financial products for you. Where third parties are involved in processing your data we will have a contract in place with them to ensure the nature and purpose of the processing is clear, that they are subject to a duty of confidence in processing your data and that they will only act in accordance with our written instructions.
Where it is necessary for your personal data to be forwarded to a third party we will use appropriate security measures to protect your personal data in transit.

To fulfil our obligations in respect of prevention of Money-Laundering and other financial crime we may send your details to third party agencies for identity verification purposes.

How long do we keep hold of your information?

Your personal data will not be held for longer than is required under the terms of our contract for services with you. We are subject to regulatory requirements to retain data for specified minimum periods. In addition, we are obliged to treat our customers fairly in the event of a future complaint and therefore reserve the right to retain data for longer than these specified minimum periods to allow us to investigate such complaints and, if necessary, defend a future claim against us.

We will therefore keep your personal information securely for as long as we need to for the purpose of providing you with financial advice under the terms of our service/fee agreement (contract) or for as long as we are required to by relevant regulations in accordance with our Data Retention Policy.

Where we are not or no longer provide you with services under our service/fee agreement we will, ordinarily, not retain personal data for longer than:

  • 12 months from an initial enquiry where you are a prospective client who does not conduct business with us
  • 6 years after a mortgage contract matures
  • 8 years after our relationship ends with you for investment services

Where we arrange a pension for you or a pension transfer, then personal information will be kept indefinitely, since this is a regulatory requirement.

We may on exception retain your information for longer periods, particularly  where we need to withhold destruction or disposal based on an order from the courts or an investigation by law enforcement agencies or our regulators.  This is intended to make sure we will be able to provide records as evidence if they’re needed.

We will regularly review our legal and regulatory obligations and our need to keep your personal information.

You have the right to request deletion of your personal data. We will comply with this request, subject to the restrictions of our regulatory obligations and legitimate interests as noted above.

How can I access the information you hold about me?

You have the right to request a copy of the information we hold about you. If you would like a copy of some or all, of your personal information, please email or write to us using the contact details noted below.  This information will be provided free of charge and within one month of being requested.

When your personal data is processed by automated means you have the right to ask us to move your personal data to another organisation for their use.

We have an obligation to ensure your personal information is accurate and up to date. Please ask us to correct or remove any information you think is incorrect.

Marketing

Unless you have told us that you do not want to hear from us, we will send you relevant marketing information (including details of other services provided by us or other selected third parties) which we believe may be of interest to you.

Rectification – You have the right to rectification of inaccurate personal information and to update incomplete personal information If you believe that any of the information that we hold about you is inaccurate you have the right to request that we restrict the processing of that information and to rectify inaccurate personal information.  Please note that if you request us to restrict processing of your information, we may have to suspend the services we provide to you.
Erasure – You have a right to request that we delete your personal information

You may request that we delete your personal information if you believe:

  • We no longer need to process your information for the purpose for which it was provided.
  • We have requested your permission to process your personal information where required for a particular purpose and you wish to withdraw your consent; or
  • We are not using your information in a lawful manner.

Please note if you request us to delete your information, we may have to suspend the services we provide to you.

Restriction – You have the right to request that we restrict the processing of your personal information

You may request that we restrict processing your personal information if you believe that:

  • Any of the information that we hold about you is inaccurate.
  • We no longer need to process your information for the purposes for which it was provided, but you require the information to establish, exercise or defend legal claims; or
  • We are not using your information in a lawful manner.

Please note that if you request that we restrict processing your information, we may have to suspend the services we provide to you.

Portability – You have a right to data portability

Where we have requested your permission to process your personal information or you have provided us with information for the purposes of entering a contract with us, you have a right to receive the personal information you provided to us in a portable format.

You may also request us to provide it directly to a third party, if technically feasible.  We’re not responsible for any such third party’s use of your account information, which will be governed by their agreement with you and any privacy statement they provide to you.

Objection – You have the right to object to the processing of your personal information

You have the right to object to us processing your personal information (and to request us to restrict processing) unless we can demonstrate compelling and legitimate grounds for the processing, which may override your own interests or where we need to process your information to investigate and protect us or others from legal claims.

Depending on the circumstances, we may need to restrict or cease processing your personal information altogether, or, where requested, delete your information.

Please note that if you object to us processing your information, we may have to suspend the services we provide to you.

Marketing – You have the right to object to direct marketing You have right to object at any time to processing your personal information for direct marketing purposes, including profiling you for the purpose of direct marketing.
Withdraw consent – You have the right to withdraw your consent Where we rely on your permission to process your personal information, you have a right to withdraw your consent at any time. We will always make it clear where we need your permission to undertake specific processing activities.
Rights related to automated decision making including profiling – you have the right to object to automated decision making without any human involvement, and to the profiling of your personal data. CFSL may use AI to support administrative tasks, research and marketing purposes. It does not however use automated decision making tools when making and giving financial advice such decisions will always be made by an adviser.
